“Wills speak at the time of death”. This is a very old saying, but still so applicable today! Your will is your voice after you die. Your last will and testament is a legal document in which you can express how you want your property to be distributed after your death, who you want to be in charge of said distribution and who will take care of your kids. In a will, you can also provide for your pets, your great grandmother’s silverware, your coin collection, your antiques and anything else you want to end in a certain person’s possession.

If you die without a will, you are said to have died intestate. In that case the law of the state in which your property is located will determine the way your property will be distributed after your death, regardless of what your wishes were. If you want to have a word on who is going to get what from the property you leave behind, you must have a will. A simple will is the only way you can control what is going to happen with all your affairs after you die.

If you die intestate and you do not have children, your property will be transferred to your parents. If your parents have predeceased you, then the property will be passed on to your siblings, even if you haven’t heard from them in years. Your spouse or domestic partner will only get the small portion of your property that the law reserves for him or her. In the absence of a will, spouses and/or domestic partners, after a life of companionship, can be left with very little. They can even lose their home, if you do die intestate.

Dying without a will, closes the doors to all your friends from inheriting from you, regardless of how dear they may be to you. You will not have the choice of leaving money to your favorite charity, cause or church. The state will decide who will take care of your children. In brief, what you think, what you want, or what your opinions are regarding what happens with all your things after you die will be totally discounted, when you die without a will. You are left out of the decision-making process altogether.

Most people would first think about using a solicitor when wanting to get their Will made. This is because they have been the first choice for many generations. Also, you tend to think of going to a solicitor whenever you want anything legal preparing. You get professional service, and, hopefully, good legal advice. You also get to speak to someone who can answer all of your concerns and queries and who will create a document that perfectly fits your own particular circumstances. This can be very reassuring. However, it can be a little intimidating to go to a lawyer and is obviously inconvenient because you have to take time out to get there. There is also the question of cost to consider. Lawyers are not cheap.

There are number of ways that you could use to find out info on people. The easiest way would be talk to the people around that person. You could talk to their colleagues or their friends. You could even try and track the person’s college and high school friends. By talking to people in the individual’s circle of friends you will be able to get the kind of information that is not available in any of the national records.

It could be a number of things that you want searched. You might want to know if the person has a criminal record. Or whether they are married, have been married or divorced. You might be interested in their financial standing as in the case of a potential business partner or investor. Whatever the circumstance it’s your right to be able to get this information.

Another place that you could try to find out info on people are the state archives of records. Do note I said state and not national. If you want a nationwide search then you will have to get extra help otherwise the information will take you weeks to gather. Even at state level doing a complete background check on someone will take up time. There are too many files to go through and chances of coming up with more than one person with the same name are high.

Verifying the data that you have compiled will certainly not be an easy process. It would be so much easier if you could access these records online and be able to carry out a nationwide search. Actually it is possible.

What kind of behavior is sufficiently “tumultuous”?  Case law from a number of states, including Massachusetts, has held that speech is only tumultuous if it rises to the level of “fighting words.”   In a New York case interpreting similar statutory language, Stephen v. New York, 581 NYS2d 981 (1992), the defendant was arrested for “clutching his genitals and shouting obscene remarks at a police officer.”  The court dismissed the charges, noting that the defendant’s behavior was “not violent, tumultuous or threatening, but merely loud, derisive, taunting and vulgar…”   Were the witnesses to the Gates’ incident really frightened that Gates was about to attack a dozen armed officers?  Did the witnesses fear personal bodily harm?  It does not seem likely.   If the onlookers had perceived Gates’ statements to be merely “loud, derisive, taunting and vulgar,” then Gates’ arrest would have to be ruled doubly unconstitutional.

Although Sgt. Crowley appears to have acted sincerely, ignorance of the law is no excuse, especially when the law we’re talking about is the Constitution.  Crowley invoked “standard police procedure” as his defense, but such procedures are not exempt from the requirements of constitutionality.

Admittedly, the Bill of Rights is a pain in the neck for our nation’s police officers.  It frequently permits criminals to escape the reach of the law.  Its only justification is that it preserves our freedom, which is why it is our national treasure.  Even at the cost of hampering law enforcement, these vital freedoms must be zealously defended

Most of us take our mobility for granted, but we are all getting older and we all slow down. As we age, our mobility can become more important as it gives us independence. Anyone living alone who begins to lose their mobility is at risk of requiring residential care.

We told them not to do the dialysis. They did not ask to see the living will. He died the next day at 10:20 am.

In that situation a living will is redundant. Its value comes in if relatives would dispute the decisions you make. You don’t want them second guessing what you do and you certainly don’t want them taking you to court.

A caregiver must be able to determine a senior’s capacity for some activities. A seniors self-confidence is lost when they feel frustrated that they can’t do something right or can’t remember the rules of a game. Therefore, it is important to remember that an activity itself is the goal, not a specific outcome.

Wheeled walkers are also commonly referred to as Rollators. They come is a variety of shapes and sizes and with numerous optional features. Two of the most common types are 3 wheeled and 4 wheeled walkers.

The 3 wheel variety is more maneuverable and able to fit in more confined spaces. It offers less supports so is suitable for those requiring only mild to moderate assistance.

In case Emergency Services is called in and you are not there to guide them, the MOLST will tell them if the Loved One does not want to be resuscitated.

My experience is based on seven years of hands on, 24/7 experience in providing elder care. I thought that the experiences we went through were unique to my family. Unfortunately, it is not.
